Acceptance of terms

By accessing or using APS, you agree to these terms. If you are using APS on behalf of an organization, you represent that you have authority to bind that organization.

Service overview

APS provides automated phone answering, call routing, and request summaries. APS is not a replacement for emergency services and is not intended for medical, financial, or high-risk decisions.

Accounts and responsibilities

  • You are responsible for maintaining the confidentiality of account credentials.
  • You must provide accurate contact and billing information.
  • You are responsible for the legality of calls and messages processed through APS.

Customer data

You retain ownership of your data. You grant FTS a limited license to host, process, and transmit data solely to provide and secure APS. We process data in accordance with the Privacy Policy.

Acceptable use

You agree to follow the Acceptable Use Policy. You may not use APS to violate laws, place unlawful robocalls, send spam, collect sensitive data without authorization, or interfere with the service.

Telephony compliance

You are responsible for complying with telephony laws (including TCPA and state analogs), consent requirements, and call-recording rules. APS does not provide legal advice or compliance determinations.

Fees and billing

Fees are described in your order form or subscription plan. If payment is late, we may suspend access until balances are current.

Third-party services

APS integrates with third-party providers for communications, cloud hosting, and payments. Your use of those services may be subject to their terms.

Intellectual property

We retain all rights in APS, including software, designs, and documentation. You retain rights to your data and content. If you provide feedback, you grant us a non-exclusive right to use it without restriction.

Confidentiality

Each party agrees to protect the other's confidential information and use it only for providing or receiving APS services.

Suspension and termination

We may suspend or terminate access if we detect violations, security risks, or legal exposure. Either party may terminate with notice. Upon termination, your access ends and we may delete or return data as required by law and contract.

Disclaimers

APS is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

Limitation of liability

To the maximum extent permitted by law, Fat Tailed Solutions will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill.

Indemnification

You agree to indemnify and hold FTS harmless from claims arising out of your use of APS, your data, or your violation of these terms or applicable law.

Governing law

These terms are governed by the laws of California, USA, without regard to conflict-of-law rules.

Changes

We may update these terms as the service changes. We will update the "Last updated" date above.
